1. About these Terms

These Terms of Service ("Terms") apply to puiumamei.com and to every purchase you make from PUIU MAMEI LLC ("PUIU MAMEI," "we," "us"). By using the site or placing an order, you agree to these Terms and to our Refund Policy, Shipping Policy and Privacy Policy, which are part of these Terms.

Nothing in these Terms limits any rights you have under the consumer protection laws of your state.

2. Who can buy

You must be the age of majority in your jurisdiction to make a purchase. The site is not directed to children under 13, and we do not knowingly collect their information.

3. Orders, prices and payment

All prices are in U.S. dollars. We may change prices at any time, but a change never applies to an order you have already placed.

Payment is due in full when you place your order. We may decline or cancel an order, for example if an item is out of stock, a price was listed in error or we suspect fraud. If we cancel an order you paid for, we refund you in full.

4. Product information

We work to show colors, materials and details accurately. Actual color and appearance may vary slightly because of screens, lighting and natural differences in materials. If we find an error in a product description or price, we will correct it and, if it affects your order, contact you before shipping.

5. Limited editions and final sale

Items marked final sale, such as limited drops and special releases, cannot be returned unless they arrive damaged or defective, as explained in our Refund Policy.

6. Using your MAMEI Bag safely

Please follow the use, care and safety instructions on the product page and the insert card.

The bag, pouches, straps and changing pad are not a child restraint, carrier or sleep product. Never leave a child unattended on the changing pad, stay within arm's reach, and never let a baby sleep on it. Hanging a bag on a stroller can make the stroller tip; follow the weight limit and your stroller maker's instructions.

7. Warranties

Our Refund Policy explains what we do if a product arrives damaged or defective. Except as stated there, and to the extent permitted by applicable law, our products and this site are provided "as is," and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

8. Limitation of liability

To the extent permitted by applicable law, PUIU MAMEI is not liable for any indirect, incidental, special or consequential damages arising from the use of our products or this site. To the extent permitted by applicable law, our total liability for any claim relating to a product will not exceed the amount you paid for that product.

These limits do not apply to personal injury or death, to fraud, gross negligence or willful misconduct, or to any liability that cannot be limited under applicable law.

9. Intellectual property

All content on this site, including the PUIU MAMEI name and logo, product names, bag designs, photos, videos, graphics and text, belongs to PUIU MAMEI LLC. You may not copy, reproduce or use it without our written permission.

10. Reviews and content you share

You are free to share honest reviews of our products, positive or negative. Nothing in these Terms restricts that. When you submit a review, photo or other content to us, you give us a non-exclusive, royalty-free license to display and share it in connection with PUIU MAMEI. You confirm the content is yours to share and is truthful.

11. Your responsibility

To the extent permitted by applicable law, you agree to cover our reasonable costs from claims caused by your misuse of this site, content you submit, or your violation of these Terms.

12. Disputes and arbitration

Please read this section carefully. It affects your legal rights, including your right to go to court.

Talk to us first. Before starting any formal claim, email info@puiumamei.com with your name, order number and a description of the problem. We will try to resolve it with you informally within 30 days.

Individual arbitration. If we cannot resolve it in 30 days, you and PUIU MAMEI agree to resolve any dispute relating to these Terms, our products or this site by binding individual arbitration, not in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator may award the same individual relief a court could.

You are giving up the right to a judge or jury. By agreeing to these Terms, you and PUIU MAMEI each give up the right to have a dispute decided in court by a judge or jury.

Small claims court. Either of us may instead bring an individual claim in small claims court if it qualifies.

No class actions. You and PUIU MAMEI may bring claims only on an individual basis, not as a plaintiff or class member in any class, collective or representative action.

13. Governing law

These Terms are governed by the laws of the State of New York and, for the arbitration section, the Federal Arbitration Act. Any dispute that is not arbitrated or brought in small claims court will be heard in the state or federal courts located in New York County, New York. This choice of law does not take away protections you have under the consumer laws of the state where you live.

14. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted with a new "Last updated" date and apply only to orders placed and use of the site after that date. They do not apply to orders already placed. A dispute that started before a change is governed by the version in force when it started.

15. Severability

If any part of these Terms is found unenforceable, that part will be limited or removed only as much as needed, and the rest of these Terms stays in effect. If the class action waiver is found unenforceable for a claim, that claim must be heard in court and not in arbitration.
